Summary:The exercise of the right of correction to the minor, in order to be a “legitimate” exercise and therefore a cause of complete justification, must be, in any of the punishments imposed, adequate, proportionate to the entity of the infraction and restrained, a “moderately correct ”. And to be a legitimate exercise, by virtue of the principle of necessity, also constitutionally based, the application of the sanction must be strictly necessary for the educational and corrective purpose of the minor or pupil, and it will not be so when a sanction of certain harshness without first testing the effectiveness of warnings or lighter sanctions.
