Despite their importance, the doctrinal and jurisprudential development of these normative provisions has been very limited, especially with regard to the recently created concept of decisive participation. In this sense, the purpose of this article is to review the normative and case law on both legal categories in order to determine their origins, scope, convergences and divergences and, to propose some approaches to their practical use in the Special Jurisdiction for Peace.Máximos responsables y participación determinante constituyen dos categorías jurídicas con mucha relevancia actual en la justicia transicional colombiana. Se trata de conceptos incorporados en la Constitución gracias a dos reformas constitucionales que han precisado aspectos puntuales que deben orientar la administración de justicia en este ámbito. Pese a su importancia, el desarrollo doctrinal y jurisprudencial de estas disposiciones normativas ha sido reducido, sobre todo frente al recién creado concepto de participación determinante.
