Summary:This study carries out a critical description of Roxin’s functional-teleological system of criminal responsibility. It is a system where facts are subject to a strict axiological frame. Among the values involved, principles strictly speaking, based on corrections grounds, are predominant against directives, that is to say, finalist or utilitarian values. Correspondingly, the contents ascribed to the diverse categories of the theory of crime shows that the theory of punishment is not the essential reference of the above-mentioned system of criminal responsibility. Finally, the Roxin’s system means a serious play-down of the systematic thought in favor of a topical approach.
