To fulfill this objective, the construction of jurisprudential lines and the dogmatic method were used as research methods.El presente artículo científico tiene como objetivo mostrar las diversas soluciones propuestas a nivel doctrinal para los problemas jurídicos derivados de la pregunta atinente a la ubicación sistemática de la “ausencia de lesividad de la conducta” en las diversas categorías dogmáticas y estructurales de la teoría del delito, para luego mostrar cuál es la línea jurisprudencial que la Sala de Casación Penal de la Corte Suprema de Justicia ha manejado al respecto, proponiendo entonces una solución desde el marco de la imputación objetiva que pueda ser plenamente satisfactoria y coherente con los engranajes constitucionales y legales que rigen para el Derecho Penal y Procesal Penal Colombiano.
