Summary:When leaving to conceive children as subjects of special protection to consider them as subjects of rights was a challenge for the Colombian State, so the investigation will analyze the constitutional and legal significance of the adoption of the Universal Declaration of the Rights of the Child of 1989 in relation to the application of the principle of the best interests of the child in the exercise of Powerful Homeland in Colombia. It is a socio-juridical research, supported by the legal hermeneutic-phenomenological method as an instrument that will facilitate finding the necessary information for the development of research postulates, in that order of ideas, the present work symbolizes a rupture of the old paradigm that envisioned the Children as subjects of special protection and on the other hand will reinforce the new vision of true subjects of rights, whose vulnerable condition the nations of the world must guard.
