Summary:In this monograph, we develop aspects related to the protection of civil liberties - and more broadly human rights, before the exercise of extraordinary powers of government protected in exceptional states decreed on the occasion of security crises in contemporary societies, protected by positive law. We will approach these objectives formulating a structured reasoning based on a basic premise: the existence of the rule of law, weighted with the antithesis that underlies the idea that the construction of the contemporary rule of law has made it necessary to establish exceptional mechanisms that empower the government to adopt urgent and necessary measures to deal with critical situations that threaten the state's own ends, which means suspending the rule of law applicable to situations of normality to ensure the survival of the same state.
