Summary: | A person's marital status is his or her "legal status in the family and society," which gives him or her certain prerogatives regarding the exercise of some of his or her rights and the acquisition of specific obligations. It should also be noted that the "assignment of this status corresponds to the Law" (Decree 1260, 1970). This is a situation closely linked to human dignity, "since every person has the right to be recognized as part of society and the family" (Judgment C 2350, 2019) Various types of family are distinguished: by adoption, marriage, de facto marital union between permanent partners, parenting, single-parent and joint, as defined by the Constitutional Court in the judgment (Sentence C-511, 2011). In this sense, it is necessary that Colombian jurisprudence refers to the foster family as that exceptional form of family that leads to a de facto relationship, based on coexistence, affection, protection, assistance and respect (Sentence T-525, 2016)The Constitutional Court established that, because it has these conditions and necessarily involves minors, this form of family would be subject to special protection by the State. |
