Summary:The redemption of the sentence and the re-socialization are two important figures in the criminal scene of a social State Law. Therefore, the institutionality aims to re-educate the citizen who has committed a crime so that when they re-enter society it is useful to this one as her family. In this way, Colombia, as a State that guarantees social rights that are represented in the 1991 Constitution, has the obligation to respect the human dignity of all its citizens, even when they are under pressure. Therefore, the main purpose of this research is to analyze the situation of the rights of prisoners in Colombian prisons, through the existing literature. Thus, there will be a broad panorama if the Colombian State respects and guarantees the effectiveness of human rights and fundamental rights, as well as the right of redemption and resocialization.
