In this investigation the relevance of the consent of the passive subject in the homicide by mercy is analyzed, studying the constitutional principles and the fundamental rights that they take to the legislator to justify the conduct of the doctor like subject assets. The method used in this investigation is the deductive one, starting off of a general vision of the subject for an individual. The consent of the passive subject in the homicide by mercy is excellent because when granting it the terminal patient on the basis of rights and fundamental principles like the dignity, solidarity and the right to the free development of the personality which exempts of responsibility the doctor. This conduct does not fit in the penal Code in article 32 and 106, for that reason, the Constitutional Court created causal the supralegal one of justification of the homicide by mercy when the consent takes part. The Constitutional Court lets to the individual in the freedom decide by the life or the worthy death. The fundamental rights are guaranteed at all the moments of the life of the man. To have right to the worthy death means that the rights are weighed with base in the human dignity. |

El método empleado en esta investigación es el deductivo, partiendo de una visión general del tema a una particular. El consentimiento del sujeto pasivo en el homicidio por piedad es relevante porque el enfermo terminal lo otorga en base a derechos y principios fundamentales como la dignidad, la solidaridad y el derecho al libre desarrollo de la personalidad y a la vez exime de responsabilidad al médico. Esta conducta no encaja en el Código penal en los artículos 32 y 106, por eso, la Corte Constitucional creó la causal supralegal de justificación del homicidio por piedad cuando interviene el consentimiento. La Corte Constitucional deja al individuo en la libertad de optar por la vida o por la muerte digna. Los derechos fundamentales se garantizan en todos los momentos de la vida del hombre.
