Summary:This research had as a general objective to analyze the access to decent housing as a constitutional guarantee in the Urbanization La Paz in Sabanalarga, Atlántico between the periods of 2018 - 2019. The specific objectives proposed in the investigation are the next ones: 1-Describe the historical background and legal advances of the right to private property as a social function. 2 - Identify the determining factors that led the inhabitants of the Urbanization La Paz in Sabanalarga to occupy the property. 3- To contrast what is established by the social state of law in relation to access to decent housing in the La Paz Urbanization. The methodology used was the qualitative nature of a social legal nature and the method of analysis was hermeneutic. The population was made up of all the inhabitants of the La Paz Urbanization. The sample was not probabilistic formed by eleven families who wanted to participate in the field work. The data collection techniques used were observation and semistructured interviews. For the analysis of results the Atlas ti was used. They are presented as the main result that the most determining factor for the acquisition of decent housing is the economic one. It is concluded that the constitutional guarantee for access to decent housing is not fully fulfilled, especially for people from low-income socioeconomic strata.
