Description
Summary:This research studies the constitutional protection of the right to life in children and adolescents in Colombia. From an initial point of view, the right to life is a fundamental right protected by international law and block of laws. However, the understanding of the right to life from the point of view of legal order does not place a total emphasis on the existence of being, of the individual, focusing on the quality of life, a dignified life and other perceptions of the concept. The objectives of this present document are to identify the factors that violate said right, the preventive and sanctioning measures thereof, and determine what are the plans by the State to reduce such vulnerability of the fundamental right. From the methodological point of view, it is presented as a descriptive research, with a qualitative approach, leaving the children and adolescents as the unit of analysis, and the violation of the right to life during 2019 and 2020. The results obtained lead to the expression of a constitutional protection with great deficiencies, lack of reports and statistics that allow to adequately direct national budgets, a jurisprudence directed towards quality of life, a dignified life and other fundamental rights, leaving aside the right to freedom. life or existence of the minor. As major factors in the violation of the right, the armed conflict, malnutrition, physical and sexual violence, homicides and others are explicit, which demand attention from the State and regulatory institutions.
