Summary:The cassation resource for its formality and its scheme is absolutely a device, it has been a topic of many questions, for the excess of formalities with which previously he was managing. With the reform of 1991 we find the decrease of these formalisms that in fact were, slightly exaggerated, but without eliminating them completely. The cassation had its origin in France hence the word casser - I will marry that it means to break in French, in this case what breaks is the judgment of the second instance. With the cassation resource one thinks about how for the unification of the national jurisprudence, to promote to the achievement of the objective right in the respective processes and repairs the indignation inferred to the parts with the appealed judgment, this indignation the judgment must decide at the moment of dropped. This alone resource proceeds against judgment of the second instance dropped by the Superior Courts, but not against all the judgments but those that one finds indicated in the article 366 of the code of civil procedure and it sedates only for the grounds stipulated in the article 368 code of civil procedure.
