Summary: | In surgical obligation, medical responsibility only appears in the head of the surgeon as head of the ward; that is why, the importance of evaluating the responsibility of all the participants of the surgical act, establishing who is responsible and who should compensate the damage. It is evident that in the presence of a surgical oblite there is a person in charge who has the obligation to repair the damage caused, also that the instrumenter's own function consists mainly of supervising the surgical medical equipment and materials that enter the surgery room. ; This being true, the assessment of responsibility should not only be directed towards the surgeon, but also towards the instrumenter and the surgical team. In this work the surgical oblite will be analyzed as an involuntary error in the exercise of surgical instrumentation and the factors that increase the risk of forgetting foreign bodies in the body of patients during a surgical intervention will be identified. This research will be of a socio-legal nature and will be carried out under the aspect of a documentary and hermeneutical study. It is concluded that the proper function of the instrumenter consists mainly in supervising the surgical medical equipment and materials that enter the operating room; This being true, the assessment of responsibility should not only be directed towards the surgeon, but also towards the surgical instrumenter and the surgical team. |
