Summary: | This study is the result of research on legislative omissions marriage legal regime against marital union in Colombia, both of which have somehow been addressed by the jurisprudence of the Colombian Constitutional Court and has transcended in various areas . Through this process legal analytical jurisprudence, legal developments are seen, warranties and obligations of couples joined by marriage and marital union in two ways: one, the possible revision of the protective actions invoked in rights protection people's fundamental and the second exercise of the constitutional role of guard and supremacy of the Constitution as binding interpretation of general and performs the Colombian Constitutional Court. It seeks to explain the disparities between marriage and marital union in Colombia, thus highlighting the Colombian regime legislative omissions regarding the marital union, it is one of the most used by the Colombians to formalize a home, despite which they do not have permanent partners equal rights that the Constitution decrees against which the legislature has not been put to the task of matching these unions for self-motivated, but that gaps of this topic and the recognition of rights has been done through mentoring. |
