La autonomía de las CAR en la jurisprudencia constitucional de Colombia: análisis de línea jurisprudencial

Public administration regarding the environment in Colombia is described as being decentralized. Based on this kind of structure, renewable natural resources are organized taking into account different ecosystem criteria which are subjected to territorial jurisdiction of the Autonomous Regional Corporations –CAR. These CARs integrate the Environmental National System –SINA- in Colombia, and despite they are not subdued to any administrative hierarchy from the Ministry of Environment, the real scope of their administrative autonomy is a source of debate. The discussion related to CAR’s independence has stressed relations between decentralized and centralized levels to the extent of resorting to the Constitutional jurisdiction in order to establish limits on the Ministry’s intervention to CARs actions, as well as to delimit CAR’s autonomy concerning certain situations.
