Description
Summary:The urban housing lease as one of the most used contractual figures and with great importance within our society. So much so, that by its practice and custom, "the phenomenon of contractual imbalance" has been generated, evidencing that in reality the parties often impose their will or the improper structuring of the lease under agreements that go beyond the sphere of protection that the law creates to guarantee rights and obligations between the parties. In this sense, it is recommended that taking into account that the lease is of successive tract and sensitive to the surviving circumstances that fall on it during its validity, during the first stage of structuring they must be free of defects of the will, of the injury, so that in its second stage the execution does not present alterations in its non-compliance, excessive onerousness, change of conditions of special agreements, modification of the business base, in short, a number of factors that affect the contractual imbalance of the urban housing lease contract.
