Summary:This study entitled "Commercial and Legal aspects about payments with checks on hold, as financial fraud in Colombia" aims to expose a national problem about checks as means of payment, in order to demonstrate that this types of securities are no longer provide any type of guarantee to their beneficiaries, either if they are bank users or not, after numerous cases and complaints of citizens, news and all kind of information from local authorities. In general terms, the main object of this research it is to analyze the legal and commercial aspects of the check on hold, as an ultime type of finance fraud in Colombia that it has becoming stronger an generalized nowadays. To achieve this object, in the first place we used a qualitative methodology in order to understand deeply this new phenomenon with local and social context; the we do a research from the legal/descriptive perspective of this issue. Thus, this study reveals the impossibility of verifying the payment of checks immediately, which turned this security into a not effective way to receive bank deposits due the fact that before you receive your payment, there is a process knowing as “waiting to be cleared” o “checks on hold”, in which there is verified the authenticity, funds and other aspects of this security. Furthermore, this study presents the incidence of this new fraud also in the e-commerce and virtual platforms for buying and selling, where the “checks or deposits on hold” has affected their market as well. In conclusion, through this research we are allow to illustrate the reader about the seriousness of this problem that is affecting the entire country and different types of commerce, either presencial or not. Finally we proposed a sort of recommendations that will allow to mitigate and prevent further problems relating to this matter.
