Summary: | The state has a double mission to be fulfilled, opposite to the competition: an action duty, to prevent from being obstructed or restringa the freedom of competition and a duty of abstention not to interfere in the exercise of the rights established in the art. 26 and 333 inc. 5 of the Political Constitution of choosing profession or office and of the free private initiative. Only when it is demanded by the social interest, the ambience or the cultural heritage of the nation, the state will be able to put limits to him within reach of the economic freedom op cit art. 333 inc. 5. The right of the competition looks for the satisfaction of the general interest, limits the exercise of the power to produce and to commercialize goods on the market, as they import an excessive exercise. The Colombian legislation on disloyal acts on the market introduces the legislative developments and existing rules and admonitions codes in the foreign legislations, the protection being highlighted across this normatividad of the interests of the consumers and of the State. |
