Summary:Constitutional tensions, neoliberalism and social rights in the constitutional process of 1991, is a document whose aim is to describe the nature of the tensions incorporated within the constitutional articles approved in 1991. Consequently, this text reviews the theoretical conceptions that supported the current legal superstructure, the political forces that participated in its process and determined the contradictions between the two great conceptions on which they were inspired. And, in that direction, an analysis of the breaking points between neoliberalism as an economic program and social rights, as a democratic claim of the constitutional articles.
