| Summary: | The present monograph or Project of degree will be in charge to characterize the tensions arisen between positive right and natural right, concretely in the sentences AHC 4806-2.017 and the sentence STL 12651-2.017 each one, where the main theme circulates in the most adequate protection for a dignified life, of the sentient being "oso chucho". The method of documentary exploration was used, according to the different bibliographies found on the subject. It was taken into account for the development of the work and characterization of tensions in the aforementioned sentences, the different theories presented over time by the exponents of greater impact in the legal field, of positive law and natural law, to achieve thus to dimension to greater plenitude, the different tensions, which were found in the development of the investigations carried out. |
