La presente monografía titulada SEGURIDAD VIAL: DILEMAS E IMPLICACIONES JURÍDICAS FRENTE AL CASO, se desarrolla con base en una apuesta teórica por dar a conocer el tema de la seguridad vial en el país, un tema en concordancia con la responsabilidad civil que deben adquirir los conductores de cualquier tipo de vehículo, así como los peatones. A través de cuatro capítulos se exponen de manera tácita, lo concerniente con los inicios del derecho romano y la responsabilidad civil, la seguridad vial en el país, el Código Nacional de Tránsito y el papel de las aseguradoras. Cada capítulo se desarrolló con base en una revisión bibliográfica y jurisprudencial sobre el tema. Para tal fin se redactaron los capítulos previa elaboración de fichas bibliográficas y una síntesis de los aspectos más relevantes según el tema. Al final, se concluye con un texto que puede dejar líneas abiertas para posteriores investigaciones o monografías. En cuanto a la metodología, es de tipo cualitativa. Pues, como bien se indicó, la apuesta central es la fundamentación teórica y la reflexión temática. Se acude a fuentes bibliográficas secundarias y se hace una aproximación contextual que dé cuenta del objetivo principal, esto es, analizar el contexto de la seguridad vial en el país, a través de una revisión jurisprudencial y temática de acuerdo con el objeto de la responsabilidad civil. |
