description Resumen del proyecto En los últimos tres años, a los ríos se les ha otorgado derechos como sujetos o personas legales en países tan diversos como Nueva Zelanda, Colombia e India. Estos casos son manifestaciones concretas de propuestas más amplias de otorgar derechos legales a la naturaleza, que han sido discutidas durante algún tiempo por científicos, activistas ambientales, comunidades indígenas y legisladores. En este proyecto, investigaremos las implicaciones de esta innovación socio-legal a través de estudios comparativos y profundos de estos tres casos. Deseamos explorar posibles tensiones y sinergias entre los derechos humanos y los derechos de la naturaleza, y si los casos de los derechos fluviales son intentos convincentes para establecer un nuevo modo de relación entre el ser humano y la naturaleza. Aunque los derechos de los ríos surgen del activismo de base en todos estos casos, no está garantizado que esta innovación legal sirva a los intereses de las bases, ni que asegure la protección de los ríos. Exploraremos estos temas a través de un enfoque interdisciplinario, involucrando a investigadores experimentados con antecedentes en antropología social, derecho, gobernanza ambiental y economía, y con experiencia profunda en los países estudiados. El proyecto producirá nuevo conocimiento relevante y crítico sobre una forma innovadora de protección ambiental, prestando especial atención a: a) los mecanismos establecidos para hacer cumplir los derechos de los ríos y sus implicaciones para la protección de los ríos y los diferentes grupos de usuarios del agua; b) las implicaciones para los marcos legales existentes y los debates sobre los derechos de la naturaleza; y c) los conocimientos que estos casos pueden ofrecer para los debates actuales sobre cómo entender la relación entre la sociedad y la naturaleza.
