La implantación del modelo neoconstitucionalista en Latinoamérica, sumada al militantismo de la Corte Constitucional por un cambio de la cultura jurídica, ha hecho que el derecho constitucional supere por mucho el ámbito del texto de la Carta. La nueva forma del derecho constitucional se estructura a través de conceptos que se derivan de los jueces constitucionales y de las interpretaciones de los derechos humanos realizadas por los órganos internacionales encargados de dicha tarea. El fundamento teórico de esta transformación es la suma del abandono del iuspositivismo, la implantación de modelos jurídicos fundados en la ponderación de principios y ya no en el ius imperium de la ley, pero fundamentalmente, en la creciente preponderancia de los derechos humanos, como un vuelco del positivismo hacia un humanismo jurídico latinoamericano.The Colombian constitutional law has undergone a fundamental turnaround in the past 17 years. The introduction of the neoconstitucionalismo model in Latin America, coupled with the militancy of the Constitutional Court by a change in the legal culture, have made constitutional law exceeds by far the scope of the text of the Charter. The new form of constitutional law is structured across concepts that are derived from the judges and constitutional interpretations of human rights carried out by international bodies.
