El autor realiza un breve estudio retrospectivo de la manifestación del consentimiento estatal desde el siglo XVII hasta la actualidad con el propósito de analizar los principios, condicionamientos y características, establecidos en el derecho de tratados, que han regido esta institución jurídica en cada contexto histórico de la sociedad internacional y demuestra que hoy el acto jurídico de consentir, como fase fundamental del proceso de celebración de tratados internacionales, requiere de una comprensión más completa y realista de los problemas teóricos y prácticos que presenta. This article expose some reflections about the essential elements of the expression of consent of the States to be bound by international treaties: the instrument – object of the consent, the represent of the State and the way to express its will. The author realize a short retrospective study of the expression of consent of the State, since the XVIIth century to the present. The purpose is to analyze the principles, the derived conditions and characteristics established in the Law of Treaties, has been governing this legal institution in each historical context of the International Society.
