A su vez, pretende demostrar cómo la información contractual es un mecanismo efectivo que fomenta o reequilibra las desigualdades existentes entre los sujetos y es una medida protectora de la parte débil de la relación prenegocial. Para lo anterior se hace un estudio sobre la modernización del derecho de obligaciones que se viene gestando en Europa donde, con fundamento en modelos basados en principios pro damnato, se está reforzando la dinámica contractual y en especial de los deberes secundarios de conducta.This article aims to define the obligations and duties of information, which assist the parties in a preliminary negotiation. In turn, aims to demonstrate how the information is a contractual mechanism that encourages or balances existing inequalities between subjects and is a protector of the weak part of the relationship.
