A partir del estudio de las normas convencionales, estatutarias y reglamentarias, la autora pone de presente que la falta de claridad, especialmente en la redacción del artículo 23 del Reglamento de la Comisión Interamericana de Derechos Humanos, ha dado lugar a confusiones innecesarias y a crear falsas expectativas en los usuarios del Sistema respecto de la amplia competencia de la CIDH en materia contenciosa. Para terminar, la autora propone una posible modificación del Reglamento al respecto, con el fin de aportar al fortalecimiento del Sistema Interamericano y a la seguridad jurídica de las disposiciones que hacen parte de dicho Sistema. This paper addresses the Inter-American Commission on Human Rights, IACHR, contentious jurisdiction with respect to the Inter-American Treaties, different from the American Convention on Human Rights, IACHR. Does the IACHR have conventional jurisdiction regarding those treaties? Do such treaties support that jurisdiction? Do the Rules of Procedure create such jurisdiction? Analyzing the different legal documents, the author pretends to demonstrate the lack of precision of article 23 of the IACHR’ Rules of Procedure, which has created severalunnecessary misunderstandings and false expectations on the Inter-American System of Human Rights’ actors, especially with respect to the IACHR Contentious Jurisdiction.
