Este trabajo de investigación está basado principalmente en el análisis del sistema de responsabilidad civil aplicable en casos de derrames de hidrocarburos en el mar, para llegar a determinarlo, se analizaron la aplicación de los regímenes de la responsabilidad civil y sus presupuestos a casos de derrames de hidrocarburos. Para llegar a determinar el régimen de responsabilidad civil aplicable, también se analizó el derecho a gozar de un ambiente sano, pues es un derecho elevado a rango constitucional el cual goza de diferentes mecanismos de protección para hacerlo efectivo, considerando que su afectación muchas veces es causa de una actividad que reporta un beneficio. Además se estudiaron las causas y efectos que produce un vertimiento de hidrocarburos en el mar teniendo en cuenta las operaciones petroleras de exploración, producción y transporte de hidrocarburos. Para corroborar el sistema de responsabilidad civil aplicable se analizó si el transporte de hidrocarburos acarrea una actividad peligrosa y si la victima puede llegar a probar la culpa del responsable. |
