Esta ley se creó para la adjudicación de tierras colectivas a poblaciones afrodescendientes. Este tema es de gran importancia hoy en día ya que en estas zonas se presentan conflictos alrededor de la propiedad, aún después de expedida la ley. Hay que tener en cuenta los problemas de esta población que ha sido históricamente discriminada, para la construcción de un mejor país. Dicho esto, se analizará la construcción del término propiedad desde la perspectiva de varios autores y la mirada del ordenamiento jurídico colombiano para abordar el contenido de la ley. Igualmente, se expondrán las ventajas y desventajas que tiene la Ley, haciendo referencia a Sentencias de la Corte Constitucional para concluir si esta ley fue beneficiosa para la comunidad afrodescendiente.

Law 70 of 1993 was enacted in order to allocate lands to the Afro-descendant segment of population in Colombia. The problems posed by the rights of ownership and how this segment of population has been discriminated are aspects considered by the paper to the extent that these phenomena hinder nation-building efforts. The notion of property is examined from the perspective of several authors and the Colombian legal framework.
