Para ello, utilizaherramientas metodológicas de derecho comparado para determinar lamanera como en otros contextos de conflictos armados se han adelantadoprocesos judiciales de naturaleza similar. El artículo explora las tesis quedefienden la realización de investigaciones e imputaciones exhaustivas eintegrales. Según esta tesis maximalista, se debe investigar la totalidad delos delitos cometidos por los postulados de la ley como única forma de cumpliradecuadamente los estándares internacionales de derechos humanos.El texto analiza estas posturas desde una perspectiva crítica por las dificultadesque entraña la investigación de esta clase de crímenes. Finalmente,el artículo concluye que una estrategia de investigación judicial menosambiciosa es más conveniente para el caso colombiano. Tal investigacióndebería concentrarse en revelar las dinámicas de sistema a las que respondenestos crímenes complejos mediante la utilización de estrategiasrazonables de priorización de los casos y de los sujetos por investigar. Estatesis, opuesta al maximalismo, garantizará más plenamente los objetivosde verdad, justicia, reparación y no repetición contenidos en la Ley. |

To do this, the articleresorts to comparative law to examine the way in which complex system crimeshave been investigated and prosecuted in contexts of transitional justice. Thearticle describes the opinions of those who defend a maximalist approachtowards those investigations and prosecutions. According to the maximalistposition, the totality of crimes and authors must be prosecuted and tried inthe framework of the Colombian Justice and Peace Act of 2005.The text discusses these opinions critically due to the difficulties that suchstrategy would involve. Finally the article concludes by showing how a lessambitious and more pragmatic approach would be clearly superior in theColombian case. Justice and Peace investigations must concentrate in thefundamental patterns of the system crimes committed; the State shouldemploy reasonable strategies for prioritizing and taking to trial the gravestcases and/or the highest responsible persons.
