De esta manera, la referida acción se encamina a procurar la vigencia y efectividad material de las leyes y de los actos administrativos, lo cual conlleva la concreción de principios medulares del Estado social de derecho, que tiendan a asegurar la vigencia de un orden jurídico, social y económico justo. El autor presenta esta figura, comparada con la adoptada en 2004 dentro del Código Procesal Constitucional del Perú, cuyo objeto es ordenar que el funcionario o autoridad pública renuente dé cumplimiento a una norma legal o ejecute un acto administrativo firme; o se pronuncie expresamente cuando las normas legales le ordenan emitir una resolución administrativa o dictar un reglamento. The object and purpose of this action is to offer him to every person, natural or legal, and even to the public servants, the possibility to respond before the judicial authority to require the execution or the fulfillment of the duty that arises of the law or of the administrative act and that is omitted for the authority, or the individual when assumes this character. In this manner, it referred action is directed to try the force and material effectiveness of the laws and of the administrative acts, which involves the concreteness of principles medulares of the Social State of Right, that tend to assure the force of a just economic, social, and legal order.
