reduciéndolo a su expresión “electoral” y el desarrollo creciente de lo que se conoce como el proceso moderno y progresivo de constitucionalización de los derechos individuales, han permitido al debate sobre los límites de la interpretación constitucional cobrar nueva relevancia. En este contexto, este artículo busca presentar un análisis de los límites de interpretación de la Constitución centrado en la relación existente entre los tribunales constitucionales y lo que se denomina como la opinión pública. Este análisis es desarrollado tomando como punto de referencia la técnica de interpretación defendida por algunos tratadistas dentro del marco del derecho constitucional norteamericano denominada “constitucionalismo popular”. En este orden, a lo largo de este artículo se busca demostrar que aunque la opinión pública es un elemento que el juez constitucional debe tener en cuenta a la hora de interpretar la Constitución, dicha opinión no es más que un elemento adicional que le permite enriquecer, sin que su observación sea obligatoria, su reflexión. En otros términos, en este artículo se busca demostrar que los tribunales constitucionales deben ser órganos soberanos y autónomos en el campo de la interpretación de la Constitución frente a la opinión pública, pues no de otra manera se puede evitar que los derechos de las minorías se pierdan bajo la fuerza de las mayorías y no de otra manera se puede lograr el desarrollo coherente y firme de los derechos individuales. |

Within this context, this article looks for to present an analysis of the Constitution interpretation limits centered in the existing relation between the constitutional courts and what it is denominated as the public opinion. This analysis is developed taking as datum point the interpretation technique defended by some American scholars within the frame of the American constitutional Law denominated “popular constitutionalism”. In this order, throughout this article one looks for to demonstrate that although the public opinion is an element that the constitutional judge must consider at the time of interpreting the Constitution, this opinion is not more than an additional element that allows him to enrich, without their observation been obligatory, his reflection.
