De igual manera, se estudia el caso en el que quien obra como transportista y le es hurtada la mercancía, alega caso fortuito o fuerza mayor y si dicha excepción es considerada válida para la misma Corte. Adicionalmente, se analiza un fallo en el que el citado tribunal revisa la posibilidad que quien no tiene derecho de dominio sobre la mercancía pero si interés negocial sobre la misma, pueda alegar interés asegurable.

Similarly, it analyzed the case in which who works as a carrier and is stolen merchandise to him, claims fortuitous event or force majeure and if the exception is considered valid for the same Court.
