El mecanismo del daño es doble. La vía más común es que los empleados públicos responsables de la contratación muestran negligencia y cometen un daño antijurídico a contratistas. Los contratistas —víctimas del daño— demandan al Estado el cual es condenado y tiene que pagar. Segundo mecanismo es la corrupción. El sistema legal queda impotente porque la contratación involucra transacciones con altos costos de transacción. El trabajo muestra que la única solución para hacer la contratación pública mas eficaz es moralizarla. La doctrina social católica podría ser de utilidad, tomando en cuenta los 400 años de la tradición jesuita en Colombia. El documento identifica los obstáculos institucionales que es necesario remover para permitir la moralización de la contratación pública con base en la doctrina social católica. Public contracting in Colombia is conflicting, inefficient that cause patrimonial damage to the State. The mechanism of the damage is double. The employees responsible for the contracting show negligence which later is condemned in the court. Second mechanism is the corruption. The legal system is impotent because the contracting involves transactions with high transaction costs. The paper suggests that the only way to make contracting efficient is to moralize it. The catholic social doctrine could be useful taking into account the 400 years of the jesuit tradition in Colombia.
