En esa medida, el presente artículo pretende establecer los orígenes de una y otra, encontrando en las tendencias de la globalización muchos de los elementos que las identifican, de tal manera que se podrían anticipar algunas dificultades en su implementación. Igualmente, se explica el alcance de ese cambio en el caso colombiano a partir de su correspondencia con esas tendencias contemporáneas de la globalización, a la vez que se hace una aproximación exploratoria sobre los efectos en la relación entre el Estado y el derecho.The change of State model has required providers to redefine their role in the classic role of intervention in the economy, so that has affected public policy rules and the delimitation exercise of regulation and control economic activity of individuals. To that extent, this article seeks to establish the origins of the two, finding the trends of globalization many elements that identify them, so that could anticipate some difficulties in its implementation.
