En el presente texto se aborda la cuestión de la aplicación del derecho injusto a partir de un caso problemático para la filosofía práctica kantiana: el agente compelido a ejecutar una orden válida pero que dicho agente considera injusta y contraria a la moral, cuyas consecuencias son eminentemente perjudiciales para la humanidad de otras personas. En este sentido, se indagará por el posible comportamiento en el cual el agente, ante las circunstancias planteadas, puede desenvolverse de forma moral y discrecional según preceptos kantianos, identificando y explicando los diferentes mandatos que le impone el imperativo categórico y la forma como ha de afrontar un eventual conflicto entre deberes éticos y jurídicos. |
