Examples of direct expropriation include nationalization, physical seizure of assets or legislated transfer of assets to the state. However such physical takings are no longer common practice. Nowadays, expropriation comes mainly in the form of “indirect expropriation”: acts and steps taken by governments which interfere with the right to the property or diminish the value of the property. This paper explores the most relevant antecedents of the concept of indirect expropriation, its appearance in the international system, the inclusion in BITs and Investment Chapters of FTAs, and the effect that the concept is having on the regulatory activity of governments.application/pdfISSN 1657-8953http://repository.urosario.edu.co/handle/10336/18616eng100No. 2177CivilizarVol. 11Civilizar, ISSN: 1657-8953, Vol.11, No.21, (julio-diciembre de 2011); pp. 77-100http://revistas.usergioarboleda.edu.co/index.php/ccsh/article/view/39/37Abierto (Texto Completo)https://creativecommons.org/licenses/by-nc-nd/4./http://revistas.usergioarboleda.edu.co/index.php/ccsh/about/editorialPolicies#openAccessPolicyhttp://purl.org/coar/access_right/c_abf2instname:Universidad del Rosarioreponame:Repositorio Institucional EdocURExpropiaciónExpropiación IndirectaAppriTratado De Libre ComercioInversión ExtranjeraNafta.Expropriationindirect expropriationBilateral Investment TreatyFree Trade AgreementForeign InvestmentNAFTA.ExpropiaciónExpropiación forzosaActos políticosThe concept of "Indirect Expropriation", its appearance in the international system and its effects in the regulatory activity of governmentsEl concepto de “Expropiación Indirecta”, su aparición en el sistema internacional y sus efectos en la actividad regulatoria de los gobiernosarticleArtículohttp://purl.org/coar/version/c_970fb48d4fbd8a85http://purl.org/coar/resource_type/c_6501ORIGINALPDF57.pdfapplication/pdf335233https://repository.urosario.edu.co/bitstreams/3a071c3f-3431-46a8-af37-1176dd3fc5d5/download942c9d23ed4f0845cdbf9e3f62013706MD51TEXTPDF57.pdf.txtPDF57.pdf.txtExtracted texttext/plain79102https://repository.urosario.edu.co/bitstreams/674977cc-daed-442a-8ec1-4b5a61df92b3/downloadea52fd0738fe8cffe4da8d45d8c1b01cMD52THUMBNAILPDF57.pdf.jpgPDF57.pdf.jpgGenerated Thumbnailimage/jpeg3874https://repository.urosario.edu.co/bitstreams/66f521b8-89f1-4926-986b-0cb0f5d77c9a/downloadb94ed024086d0d2dbeae742363c5bb45MD5310336/18616oai:repository.urosario.edu.co:10336/186162019-09-19 07:38:03.190837http://revistas.usergioarboleda.edu.co/index.php/ccsh/about/editorialPolicies#openAccessPolicyhttps://repository.urosario.edu.coRepositorio institucional EdocURedocur@urosario.edu.co |
