Among them were managers and former employees of nine oil palm companies, including Urapalma SA. The judge ordered the restitution of the communal lands and financial com pension for the victims. This is one of the first criminal rulings that we know of where firms have been held accountable for their role in the vip lence perpetrated during the internal armed conflict, creating an interest ing precedent for future cases. This is an unexpected outcome in Colombia, based on the particu lar historical, political, social and cultural dynamics, and given what we know from the emerging literature on corporate human rights abuses. It is not difficult to imagine why corporations are involved in human rights abuses in a country like Colombia. y the one hand, the country has an ongoing internal armed conflict, low scores in governance and rule of law indexes, and high levels of corruption. On the other hand, govern ments have adopted several development plans focused on attracting FDI and aiming to increase the country's participation in global markets. It is, however, difficult to imagine that companies (or business people) could be held accountable through criminal proceedings and much less that repara tion for victims would be possible.application/pdfhttps://doi.org/10.1057/978-1-137-56694-2ISBN: 978-1-137-56693-5EISBN: 978-1-137-56694-2https://repository.urosario.edu.co/handle/10336/28528engPalgrave Macmillan166149Law and Policy in Latin America: Transforming Courts, Institutions, and RightsLaw and Policy in Latin America: Transforming Courts Institutions and Rights, ISBN: 978-1-137-56693-5; EISBN: 978-1-137-56694-2, Chapter 9 (2017); pp. 149-166https://www.palgrave.com/gp/book/9781137566935Restringido (Acceso a grupos específicos)http://purl.org/coar/access_right/c_16ecLaw and Policy in Latin America: Transforming Courts, Institutions, and Rightsinstname:Universidad del Rosarioreponame:Repositorio Institucional EdocURUsing Judicial ActionsAddress Corporate Human Rights AbusesColombia 2000–2014Restitution of the communal landsUsing Judicial Actions to Address Corporate Human Rights Abuses: Colombia, 2000–2014Uso de acciones judiciales para abordar los abusos de derechos humanos corporativos: Colombia, 2000-2014bookPartParte de librohttp://purl.org/coar/version/c_970fb48d4fbd8a85http://purl.org/coar/resource_type/c_3248Bernal-Bermudez, Laura10336/28528oai:repository.urosario.edu.co:10336/285282021-06-03 00:49:51.276https://repository.urosario.edu.coRepositorio institucional EdocURedocur@urosario.edu.co |
