A prime example of this situation is the tension between the state duties under icl, to investigate and prosecute ius cogens crimes, even if they are committed by the highest representatives of foreign states, and the pil customary rules on the latter’s personal and functional immunity from foreign criminal jurisdiction. Attempts by the icj and the ilc Special Rapporteur to limit this tension have been met with strong criticism. The various arguments against both approaches show the significant difficulties to overcome the tensions caused by the overlap between icl and pil. In light of this situation, a stricto sensu definition of icl should be adopted as a way to establish a clearer demarcation between icl and pil and to limit the scope of their overlap.application/pdfhttps://doi.org/10.1163/15718123-02001002ISSN: 1567-536XEISSN: 1571-8123https://repository.urosario.edu.co/handle/10336/27104engBrillNijhoff211International Criminal Law ReviewVol. 19International Criminal Law Review, ISSN: 1567-536X;EISSN: 1571-8123, Vol.19 (2019); pp.1-21https://brill.com/view/journals/icla/aop/article-10.1163-15718123-02001002.xmlRestringido (Acceso a grupos específicos)http://purl.org/coar/access_right/c_16ecInternational Criminal Law Reviewinstname:Universidad del Rosarioreponame:Repositorio Institucional EdocURInternational criminal lawPublic international lawPersonal immunityFunctional immunityIus cogensInternational crimesDuty to investigateDuty to prosecuteThe tension between state duties to investigate and prosecute ius cogens crimes and immunity of the highest state representatives from foreign criminal jurisdictionLa tensión entre los deberes estatales de investigar y enjuiciar los delitos de ius cogens y la inmunidad de los máximos representantes estatales de jurisdicción penal extranjeraarticleArtículohttp://purl.org/coar/version/c_970fb48d4fbd8a85http://purl.org/coar/resource_type/c_6501Olasolo Alonso, HéctorMartínez-Vargas, Juan RamónQuijano Ortiz, Laura10336/27104oai:repository.urosario.edu.co:10336/271042021-06-03 00:50:05.741https://repository.urosario.edu.coRepositorio institucional EdocURedocur@urosario.edu.co |

The lack of a demarcation between international criminal law (icl) and public international law (pil) creates a set of complex issues resulting from their overlap.
