Despite their overlapping scope of application, the differences between the approaches of International Criminal Law (ICL) and Transitional Justice (TJ) are so profound that, unless dogmatisms are left aside and a process of dialogue is entered into, it will not be possible to harmonize the current legal regime of international crimes with the need to articulate transitional processes that are capable of effectively overcoming authoritarian regimes and armed conflicts. The serious material limitations shown by national, international and hybrid ICL enforcement mechanisms should be acknowledged and the goals pursued by ICL should be redefined accordingly. A minimum level of consensus on the scope of application, goals and elements of TJ should also be reached. Situations of systematic or large scale violence against the civilian population by transnational criminal organizations increase the challenge.application/pdfhttps://doi.org/10.1163/9789004341005ISBN: 978-90-04-34099-2EISBN: 978-90-04-34100-5https://repository.urosario.edu.co/handle/10336/30029engBrill Academic PublishersInternational Criminal Law, Transnational Criminal Organizations and Transitional JusticeInternational Criminal Law, Transnational Criminal Organizations and Transitional Justice, ISBN: 978-90-04-34099-2; EISBN: 978-90-04-34100-5 (2018); 234 pp.https://brill.com/view/title/34518Restringido (Acceso a grupos específicos)http://purl.org/coar/access_right/c_16ecInternational Criminal Law, Transnational Criminal Organizations and Transitional Justiceinstname:Universidad del Rosarioreponame:Repositorio Institucional EdocURHuman Rights and Humanitarian LawInternational Criminal LawPublic International LawGeneral InterestInternational Law International LawInternational Criminal Law, Transnational Criminal Organizations and Transitional JusticeDerecho penal internacional, organizaciones criminales transnacionales y justicia transicionalbookLibrohttp://purl.org/coar/version/c_970fb48d4fbd8a85http://purl.org/coar/resource_type/c_2f33Olasolo Alonso, Héctor10336/30029oai:repository.urosario.edu.co:10336/300292020-09-11 16:07:23.163https://repository.urosario.edu.coRepositorio institucional EdocURedocur@urosario.edu.co
