El enfoque principal de este trabajo es analizar el impacto laboral que ha tenido el modelaje webcam en el territorio colombiano frente a las garantías laborales y constitucionales que tienen las mujeres que se dedican a esta actividad, a la luz de la sentencia T-109/2021, que fue fundamental para el desarrollo y reconocimiento de sus derechos. Asimismo, hablar de cómo se introdujo el modelaje webcam en el contexto colombiano, puesto que no ha existido una ley o decreto en dicha materia que establezca cada uno de los lineamientos que se tienen para este tipo de asuntos. Con relación a lo anterior, se logra evidenciar que las garantías laborales y constitucionales que han tenido las mujeres webcam ha sido una construcción adelantada por la jurisprudencia en cabeza de la Corte Constitucional y de difícil acceso, puesto que fue un gran desafío debido a que se trató de un concepto totalmente nuevo en el marco normativo colombiano. |
