Purpose: the work consisted in the analysis of local regulations for the enforcement of the Environmental Subpoena in Florencia, Caquetá (Colombia). For this, municipal agreements 024 of 2009 and 013 of 2011 were taken into account, as well as the community’s degree of knowledge during the three-year implementation of the Environmental Subpoena, in order to determine the causes for the low enforceability of the subpoena. This will contribute to a possible amendment to the municipal agreements described, thus improving enforceability and implementation of the regulation. Description: in the performance of the work, the municipal agreements on the subject were collected, reviewed and analyzed, and 50 surveys were randomly applied to residents of the downtown area of the city in order to evaluate their knowledge of the environmental subpoena. Point of view: the result obtained reflects that 60 % of the population surveyed wants citizen education, enforcement of the subpoena, recycling, separation at source and prohibition to throw garbage; likewise, it was obtained that, on average, 37 people (equivalent to 74 %) claimed to be aware of the existence of actions that merit a subpoena; the rest (13 people, equivalent to 26 %) responded not knowing about the issue. Conclusions: this shows that the low enforcement of the EnvironmentalSubpoena is due, above all, to the population’s minimum social responsibility, the failure to approve agreements, and the lack of empowerment on the part of those responsible for its regulation, implementation and enforcement. |

Para esto se tuvieron en cuenta los acuerdos municipales 024 de 2009, y 013 de 2011, así como el grado de conocimiento de la comunidad durante los tres años de implementación del Comparendo Ambiental, con el propósito de determinar las causas de la baja aplicabilidad del comparendo que contribuirán a una posible modificación de los acuerdos municipales descritos, y así mejorar la aplicabilidad e implementación de la norma. Descripción: en el marco del desarrollo del trabajo, se recopilaron, revisaron y analizaron los acuerdos municipales sobre el tema, y se aplicaron 50 encuestas de manera aleatoria a pobladores de la zona céntrica de la ciudad, evaluando el conocimiento del comparendo ambiental. Punto de vista: el resultado obtenido refleja que el 60% de la población encuestada desea que se lleve a cabo educación ciudadana, aplicación de comparendo, reciclaje, separación en la fuente y la prohibición de botar basuras; asimismo, se obtuvo que, en promedio, 37 personas (equivalente al 74 %) afirmaron tener conocimiento de la existencia de acciones que ameritan comparendo; el resto (13 personas, equivalente al 26 %) respondieron no saber sobre el tema. Conclusiones: lo anterior evidencia que la baja aplicabilidad del Comparendo Ambiental obedece —sobre todo— a la mínima responsabilidad social de la población, la falencia en los acuerdos de aprobación y el poco empoderamiento por parte de los responsables de su reglamentación, implementación y aplicaciónPropósito: este trabalho consistiu na análise da normatividade local para a aplicação da multa ambiental em Florencia, Caquetá (Colômbia). Para isso, foram considerados os acordos municipais 24 de 2009 e 13 de 2011, bem como o grau de conhecimento da comunidade durante os três anos de implantação da multa ambiental, com o propósito de determinar as causas da baixa aplicabilidade da multa que contribuirão para uma possível modificação dos acordos municipais descritos e assim melhorarão a aplicabilidade da norma e sua implantação. Descrição: no âmbito do desenvolvimento do trabalho, foram coletados, revisados e analisados os acordos municipais sobre o tema; além disso, realizaram-se 50 enquetes de maneira aleatória a moradores da área central da cidade, em que se avaliou o conhecimento da multa ambiental. Ponto de vista: o resultado obtido reflete que 60 % da população pesquisada deseja que seja realizada educação cidadã, aplicação de multa, reciclagem, separação na fonte e proibição de jogar lixo em lugares indevidos; ainda, obteve-se que, em média, 37 pessoas (equivalente a 74 %) afirmaram ter conhecimento da existência de ações que merecem multa; o restante (13 pessoas, equivalente a 26 %) responderam não saber sobre o tema.
