Aim: This article carries out a documentary review on organ transplantation and its relations from a legal point of view, building on the international principles governing transplants. It also intends to analyze how this activity is regulated by our substantive legal system. Period covered, origin and types of publications: A search was made on databases and literature described in medicine books, as well as in current legal texts of the Venezuelan legal system with relevant information on the new legislation. Point of view: In medical-legal research, professionals must deal with the sensitive subject of donation and transplantation, which often represents a decisive point because of the imposed presumed consent to organ, tissue and human cell donation and transplantation contained in the new law. Conclusions: In establishing the presumed donation consent, current legal regulations on organ, tissue and cell donation and transplantation create uncertainty about how it operates in practice and tend to violate basic, ethical and legal principles, if we start from a conception based on universal human rights such as the right to health as part of the right to life and the right to self-determination, among others. |

Se propone también analizar el modo en que se encuentra regulada tal actividad en nuestro ordenamiento legal sustantivo. Periodo que se abarcó, origen y tipos de publicaciones: se realizó una búsqueda en bases de datos y en literatura descrita en libros de medicina, así como en textos legales vigentes en el ordenamiento jurídico venezolano con información relevante sobre la nueva legislación. Punto de vista: en la investigación médico-jurídica los profesionales deben enfrentar el sensible tema de la donación y el trasplante, el cual muchas veces representa un punto álgido en razón al impositivo consentimiento presunto en la donación y los trasplantes de órganos, tejidos y células humanas que figura en la nueva ley. Conclusiones: la normativa legal vigente sobre donación y trasplante de órganos, tejido y células, al establecer el consentimiento presunto de la donación, genera cierta incertidumbre sobre cómo opera en la práctica y tiende a violar principios elementales, éticos y legales, si se parte de una concepción basada en los derechos humanos universales, como lo es el derecho a la salud en cuanto parte del derecho a la vida y el derecho a la autodeterminación, entre otros.Objetivo: este artigo realiza uma revisão documental sobre os transplantes de órgãos e suas relações do ponto de vista jurídico, com base nos princípios internacionais que regem os transplantes. Propõe- -se também analisar como esta atividade é regulada em nosso sistema legal substantivo. Período coberto, origem e tipos de publicações: realizou-se uma pesquisa em bases de dados e literatura descrita em livros de medicina, bem como em textos legais vigentes no ordenamento jurídico venezuelano com informações relevantes sobre a nova legislação. Ponto de vista: na pesquisa médico-jurídica, os profissionais devem enfrentar a delicada questão da doação e do transplante, que muitas vezes representa um ponto crítico por causa do consentimento presumido imposto na doação e transplante de órgãos, tecidos e células humanas, o qual aparece na nova lei.
