description Introduction: this article presents a descriptive study on the treatment of environmental damage in its double legal assessment, based on the general theory of damage. It includes some relevant jurisprudence and case law trends in recent times, in order to inquire whether the transposition of classic damage is sufficient to understand environmental damage and ecological damage, taking into account its features and the characters of environmental damage. Methodology: the descriptive approach and the deductive method were applied to study the environmental phenomenon from its two conceptual dimensions: environmental damage and ecological damage, which respond to realities, effects and liabilities that are appreciated differently. These aspects should be assessed holistically in order to establish a clear vision of difference and similarity factors, with their consequent involvement in responsibility. Results: conceptions of environmental damage and ecological damage, from the legal point of view, cannot be treated as equivalent meanings, since difference factors have been established from jurisprudence and case law, finding that the natural environment represents the difference factor  between classic damage and environmental damage, while similarity is given by the effect on the personal, equity and moral spheres they connote. Conclusions: in order to attain a correct meaning of environmental damage, it is necessary to detach it from its equity implication and avoid establishing priority categories of environmental damage over ecological damage.

Recoge algunas tendencias doctrinales y jurisprudenciales relevantes en los últimos tiempos, con el fin de indagar si la transposición del daño clásico es suficiente para comprender el daño ambiental y el daño ecológico, teniendo en cuenta sus características y los caracteres del daño ambiental. Metodología: se aplicó el enfoque descriptivo y el método deductivo para estudiar el fenómeno ambiental desde sus dos dimensiones conceptuales: el daño ambiental y el daño ecológico, las cuales atienden a realidades, efectos y responsabilidades de apreciación diferente. Estos aspectos deben valorarse holísticamente en el propósito de lograr establecer una visión clara de los factores de similitud y diferenciación, con su consecuente implicación en materia de responsabilidad. Resultados: las concepciones de daño ambiental y daño ecológico, desde el punto de vista jurídico, no pueden ser tratadas como acepciones equivalentes, toda vez que doctrinal y jurisprudencialmente se han establecido factores de diferenciación, encontrando que el medio ambiente natural representa el factor diferenciador del daño clásico del daño ambiental, mientras que la similitud se representa por la afectación en la esfera personal, patrimonial y moral que connotan. Conclusiones: a fin de lograr una acepción acertada del daño ambiental, es necesario desligar su implicación patrimonial, evitando establecer categorías de prelación del daño ambiental sobre el ecológico.Introdução: este artigo trata de um estudo descritivo sobre o tratamento do danoambiental em sua dupla valoração jurídica a partir da teoria geral do dano. Percorre algumas tendências doutrinais e jurisprudenciais relevantes nos últimos tempos, com o objetivo de indagar se a transposição do dano clássico é suficiente para compreender o dano ambiental e o dano ecológico, considerando suas características e os caracteres do dano ambiental. Metodologia: aplicaram-se a abordagem descritiva e o método dedutivo para estudar o fenômeno ambiental a partir de suas duas dimensões conceituais: o dano ambiental e o dano ecológico, as quais atendem a realidades, efeitos e responsabilidades de percepção diferente. Esses aspectos devem ser avaliados holisticamente para conseguir estabelecer uma visão clara dos fatores de similitude e diferenciação, com sua consequente implicação em matéria de responsabilidade. Resultados: as concepções de dano ambiental e dano ecológico, do ponto de vista jurídico, não podem ser tratadas como acepções equivalentes, uma vez que doutrinal e jurisprudencialmente têm se estabelecido fatores de diferenciação, encontrando que o meio ambiente natural representa o fator diferenciador do dano clássico do dano ambiental, enquanto a similitude se representa pela afetação na esfera pessoal, patrimonial e moral que conotam.
